Pravo na otpremninu

PITANJE: Zaposlena sam godinu dana i poslodavac mi je rekao da zaključno sa 31.12.2020. godine prestajem sa radom,  jer zbog ekonomske krize izazvane pandemijom koronavirusa poslodavac zatvara firmu.Interesuje me da li imam pravo na otpremninu?

ODGOVOR: U članu 194. Zakona o radu RS- a je navedeno da radniku koji je zaključio ugovor o radu na neodređeno vrijeme, a kojem radni odnos prestaje otkazom ugovora o radu od strane poslodavca, nakon najmanje dvije godine neprekidnog rada kod poslodavca, poslodavac je dužan da isplati otpremninu, osim ako mu radni odnos prestaje otkazom ugovora o radu u slučajevima iz člana 179. stav 1. t. 2) i 5) i st. 2. i 3. istog člana ovog zakona. Obzirom da ste radili kraće od dvije godine kod tog poslodavca nemate pravo na otpremninu.
